  1. Criteria for determining the disability: Unable to move from place to place without the aid of a mechanical device or a physical impairment verified, in writing, by the Director of the division of rehabilitation or a licensed physician.

  2. Placard design: A placard issued by the Commissioner of Revenue.

  3. Parking space provisions: Each space marked with an official upright sign identifying such space as reserved for use by persons with disabilities.

  4. Enforcement/Penalties: Any person that parks in the parking space designated for persons with disabilities when not entitled to it - Class B traffic infraction and the maximum fine under it; any person that parks a commercial carrier vehicle in the parking space designated for persons with disabilities when not entitled to it - Class B traffic infraction and twice the maximum penalty under it; any person that misuses or abuses the parking privileges using what purports to be but is not a placard issued to a person with a disability - a misdemeanor punishable by a fine of $500; any person that misuses or abuses the parking privileges using the placard when not entitled to it - a misdemeanor with twice the fine that would otherwise be imposed; any person to whom the placard was issued that misuses such a placard, the placard may be revoked and reissuance may be denied subsequently.
