Delaware

  1. Criteria for determining the disability: Permanent loss of the use of leg or both legs; unable to move without the use of a wheelchair or crutches; restricted by lung disease; a physical disability as certified by a licensed physician which substantially impairs the person's mobility and which is so severe that the person would endure a hardship or be subject to a risk of injury if the privilege was denied.

  2. Placard design: Removable windshield placard displaying the permit number, the name of the issuing authority, the designation, the date of expiration and the International Symbol of Access issued by the Department of Motor Vehicles.

  3. Parking space provisions: Outlined with paint and posted with a permanent sign located at least 3 feet above the grade that bears the internationally accepted symbol of access and the caption "Reserved parking". 

  4. Enforcement/Penalties: Any person that is not handicapped who intentionally and falsely represents itself in order to get such a permit - a fine of not less than $50 nor more than $100 for the first offense, a fine of not less than $100 and not more than $200 or imprisonment not less than 10 nor more than 30 days or both for each subsequent like offense; any person that parks in the parking space designated for persons with disabilities when not entitled to it - a fine of not less than $50 and not more than $100.
