Criteria for determining the disability: Unable to walk 100 feet without stopping to rest; unable to walk without the use of a brace, cane, crutch, another person, prosthetic device, etc.; restricted by lung disease; use of a portable oxygen needed; restricted by a cardiac condition; restricted by arthritic, neurological, orthopedic condition in its ability to walk at least 100 feet; severe visual impairment.
Placard design: A white permanent placard with the blue background, and a white temporary placard with the red background displaying the International Symbol of Access to the physically disabled person issued by the Department of Revenue.
Parking space provisions: Each space will be marked by vertically mounted signs bearing the International Symbol of Access; complies with ADA Standards.
Enforcement/Penalties: Any person that parks in the parking space designated for persons with disabilities not entitled to it - unclassified misdemeanor punishable by a fine of not less than $50 nor more than $100; any person that fails to return placards or identification cards upon the death of the person with disability - unclassified misdemeanor punishable by a fine of not more than $50; any person that uses an expired or revoked or suspended placard - an unclassified misdemeanor punishable by a fine of not less than $100 nor more than $300; any person that misuses or abuses the placard issued to another person - unclassified misdemeanor punishable by a fine of not less than $100 nor more than $300; any person that is not handicapped who intentionally and falsely represents itself in order to get such a permit - Class C misdemeanor.
