Criteria for determining the disability: Unable to walk 200 feet without stopping to rest; unable to walk without the use of a brace, cane, crutch, another person, prosthetic device, etc.; restricted by lung disease; use of portable oxygen needed; restricted by a cardiac condition; restricted by arthritic, neurological, orthopedic condition; a blind person or whose vision with glasses is so defective as to prevent the performance of ordinary activity for which eyesight is essential as certified by a licensed opthalmologist, optometrist, or the Division of Services for the Blind.
Placard design: A removable parking windshield placard that contains International Symbol of Access that is white on a blue background, identification number, expiration date and the seal or other identification of the department issued by the Department of Motor Vehicles.
Parking space provisions: Each space will be marked with the sign in conformance with the Manual on Uniform Traffic Control Devices for Streets and Highways published by the US Department of Transportation. A sign designating a parking space for handicapped persons must state maximum penalty for parking in the space in violation of law.
Enforcement/Penalties: Any person that parks in the parking space designated for persons with disabilities when not entitled to it - an infraction punishable by a penalty of at least $100 but not more than $250; Any person that sells a distinguishing license plate, a removable windshield placard - Class 2 misdemeanor punishable by a fine but no imprisonment.
